GENERAL GAME CONDITIONS FOR PROMOTIONAL CHANCE GAMES

1. General

1.1 These General Game Conditions for Promotional Chance Games (hereinafter: "general

game conditions") apply to all promotional chance games organised by Stipt Polish Point B.V. and Stipt Polish Point Shop B.V. (hereinafter: "Organiser") on Stipt's communication channels, such as our website, our newsletters, our social media pages (Facebook, Twitter, Instagram, TikTok, YouTube, etc.), hereinafter referred to as: "the promotion".

By participating in the relevant promotion, the participant agrees to the following conditions:

1.2 Participation in the Promotion implies acceptance of the Promotion Conditions.

1.3 The Promotion is offered in accordance with the 2014 Code of Conduct for Promotional Chance Games.

1.4 The Promotion Conditions can be consulted at https://www.stiptpolishpointshop.nl/.

2. Participation

2.1 Participation in a Promotion is excluded for employees of the Organiser and/or employees of suppliers, sponsors and/or partners directly involved in the Promotion.

2.2 Participants under the age of 18 can only participate in the Promotion with the consent of (one) parent(s) or legal guardian. If a prize is not suitable for a young target group, for example in the case of a car, minors will be excluded even after legal representation.

2.3 The Organiser may request the participant's date of birth and/or a copy of a valid identification document.

2.4 Participation through an intermediary is not permitted.

2.5 Participation in the Promotion is free of charge, unless stated otherwise in the announcement of the Promotion ("Announcement"), in which case the costs per participation will not exceed the communication costs of €0.45 mentioned for the respective promotion.

2.6 The Organiser is entitled to exclude a participant from a Promotion or refuse to award a prize if it believes that the participant is not acting in accordance with the Promotion Conditions, has provided incorrect, incomplete or misleading information or has acted fraudulently in any other way.

3. How to play

3.1 Details about the Promotion (such as the participant's performance - if requested -, dates for submission, prizes, date of determination of the winner, etc.) will be stated in the Announcement. The value of the prize package will always be under €100,000, and a maximum of 20 draws will take place.

3.2 If a performance is requested on which intellectual property may rest, the participant declares that they own all intellectual property rights to the performance and do not infringe on the rights of third parties. The participant hereby grants permission to the Organiser and any partners involved in the Promotion according to the Announcement, to use the performance for promotional purposes or for other purposes if stated in the Announcement. "Use" shall mean all current and future forms of exploitation and disclosure of the performance. The participant will not receive any compensation for this intended use by the Organiser or the relevant partners.

4. Prizes

4.1 The determination of the winner(s) will take place impartially.

4.2 The prizes are personal and cannot be exchanged for cash or another prize. By waiving the prize, the right to the prize also lapses, and a new winner will be determined impartially.

4.3 The winners will be notified personally no later than three months after the end of the Promotion, via the e-mail address or phone number provided by them. If a winner does not respond within 14 days, his/her right to the prize will lapse, and a new winner will be determined impartially.

4.4 The winners will be announced on the Promotion website(s) and/or other social media used by the Organiser and any partners involved in the Promotion.

4.5 By participating in the Promotion, the winner agrees to cooperate in promotional activities related to the Promotion, including the presentation of the prize. Any photos/videos of this may be used by the Organiser for publicity purposes, for which consent is given through participation.

4.6 No correspondence will be entered into regarding the outcome of the Promotion.

4.7 The Organiser will arrange for the payment of gambling tax, if due.

5. Use of data

5.1 The data obtained by the Organiser in connection with the Promotion will be included in a database under its responsibility and will be treated confidentially and in accordance with the General Data Protection Regulation.

5.2 By participating in the Promotion, the Participant accepts that personal data will be registered and used by the Organiser for the purpose of carrying out the Promotion, which includes corresponding within the framework of the Promotion and, if the participant has agreed to this via opt-in, sending the additional information mentioned in the opt-in.

5.3 The participant agrees to the Organiser's privacy policy.

6. Liability

6.1 The Organiser, its partners, and third parties engaged by it are not liable for any damage, direct and/or indirect, arising from or in any other way related to the Promotion, such as but not limited to:

a) any additional costs that the winners may incur in connection with the acceptance and use of the prizes;

b) damage in connection with (the use of) the prizes awarded by it;

c) visible or hidden defects in the prizes awarded by it;

d) damage during delivery (shipping) of the prize;

e) the completeness and accuracy of the information displayed or provided by the Organiser;

f) computer and/or internet malfunctions;

g) the consequences of incorrect (contact) details provided by the participant;

h) damage in connection with the modification or termination of the Promotion.

6.2 The Organiser does not provide any guarantees on the prizes it provides.

7. Miscellaneous

7.1 In cases not provided for in these Promotion Conditions, a decision will be made by the Organiser.

7.2 If one or more provisions of these Promotion Conditions are void or annulled, the Organiser will determine a replacement provision that approximates the purpose and intent of the void or annulled provision as much as possible.

7.3 Complaints about this promotion can be directed to info@stiptpolishpoint.nl or by letter (Stipt Polish Point B.V., Eindhovenseweg Zuid 57, 5683 PW Best), stating "Complaint promotional chance game", within ten days after the complaint arose or reasonably became known. The Organiser will handle the complaint and contact the participant about its resolution. If the complaint has not been handled to the participant's satisfaction, it is possible to submit a complaint to the Dutch Gaming Authority (Kansspelautoriteit) regarding promotional chance games.

7.4 Dutch law applies exclusively to a Promotion and the Promotion Conditions. Any disputes arising from the Promotion Conditions or the Promotion can only be submitted to the competent court of the East Brabant District Court.
