1.1 In these General Promotional Terms and Conditions, the following definitions apply:

  • “SPPS”: Stipt Polish Point Shop B.V., having its registered office at Eindhovenseweg-Zuid 57, 5683 PW, Best, the Netherlands, registered with the Dutch Chamber of Commerce under number 84448873, and the organizer of the Promotion.
  • “Participant”: Any natural or legal person participating in a Promotion.
  • “Promotion/Prize Draw”: A prize draw organized by SPPS in which one or more Participants may win a prize. The prize draw is a game that forms part of a concluded purchase agreement.
  • “General Promotional Terms and Conditions”: These present general terms and conditions.
  • “Supplementary Promotional Terms and Conditions”: Additional terms applicable to a specific Promotion, supplementing these General Promotional Terms and Conditions.
  • “Promotional Terms and Conditions”: The General Promotional Terms and Conditions together with any applicable Supplementary Promotional Terms and Conditions.
  • “Promotion Period”: The period during which the Promotion is active, ending at the time of the draw.
  • “Sealed Container”: A lockable barrel sealed by SPPS, into which copies of all delivery notes from Participants are inserted during the Promotion Period via a slot in the sealed lid. The seal is broken during the draw.
  • “Winner”: The Participant whose delivery note copy is drawn from the Sealed Container during the draw following the Promotion Period and thereby wins a prize. All provisions referring to Participants also explicitly apply to the Winner.
  1. General

2.1       Supplementary Promotional Terms and Conditions may apply in addition to these General Promotional Terms and Conditions. In case of conflict, the Supplementary Terms shall prevail.

2.2       If any provision of the Promotional Terms and Conditions is found to be invalid or unenforceable under applicable law or by final court judgment, the remaining provisions shall remain in full force and effect.

2.3       SPPS reserves the right to amend the Promotional Terms and Conditions at any time during the Promotion without prior notice, or to terminate or modify the Promotion without obligation to provide explanation or compensation to any Participant.

2.4       Questions or comments regarding a Promotion may be submitted via the email address specified in the Supplementary Promotional Terms and Conditions. If none are provided, inquiries may be sent to info@stiptpolishpoint.nl.

2.5       Participants submitting inquiries or complaints must provide:

  1. The name or description of the Promotion;
  2. The delivery note as proof of participation;

III. The date of participation and order number;

  1. In case of a complaint: a clear, reasoned description of the complaint and the desired resolution. SPPS aims to respond within 30 days of receipt.

2.6       If the Participant fails to provide the required information as described above, the complaint will not be processed. SPPS may notify the Participant of this, but is not obligated to do so. SPPS bears no liability for not responding to inquiries or complaints that do not meet the conditions of Article 2.5.

  1. Participation

3.1       A natural or legal person becomes a Participant in a Promotion by placing an order with SPPS during the Promotion Period. The ordered products are shipped by SPPS along with a delivery note. The Participant is thereby also the purchaser. The general terms and conditions of Stipt Polish Point Shop B.V. apply to the purchase agreement.

3.2       It is the sole responsibility of the Participant to retain the delivery note. SPPS places a copy of the delivery note into the Sealed Container. This copy, together with the original delivery note, serves as proof of participation. Without complete proof, the Participant is excluded from the Promotion.

3.3       By placing an order during the Promotion Period, the Participant agrees to these Promotional Terms and Conditions. The Participant must not indicate a desire to be excluded from the Promotion. Once the live draw has occurred, the right of withdrawal is forfeited.

3.4       Participants must be at least 18 years old. SPPS reserves the right to verify age.

3.5       If participation is open to individuals under 18, written consent from a parent or guardian is required. Unless explicitly stated otherwise, participation is not permitted for individuals under 18.

3.6       Employees of SPPS and anyone involved in organizing the Promotion are excluded from participation.

3.7       The Participant guarantees that all information provided is accurate, current, and complete.

3.8       If any of the conditions in this article are not met, the Participant is excluded. The conditions for participation are listed below:

  1. a) Order placed and paid during the Promotion Period via www.stiptpolishpointshop.nl, the physical store in Best, or an authorized external retailer, with written confirmation of participation if via an external retailer;
  2. b) Ability to present the delivery note upon winning;
  3. c) Acceptance of SPPS’s General Terms and Conditions;
  4. d) Acceptance of these Promotional Terms and Conditions, including forfeiture of withdrawal rights after the live draw;
  5. e) Acceptance of any applicable Supplementary Promotional Terms and Conditions;
  6. f) No self-requested exclusion from participation;
  7. g) Active subscription to the Stipt Polish Point YouTube channel (free);
  8. h) Minimum age of 18;
  9. i) No disqualifying role as defined in Article 3.7;
  10. j) All provided information is truthful and accurate.

3.9       If a Winner is later found to have been ineligible, SPPS may reclaim the prize within five years under Article 6:203 of the Dutch Civil Code. If the prize cannot be returned, SPPS may claim compensation under Article 6:87(1).

3.10     This also applies if the Winner should have been excluded but was not due to circumstances beyond SPPS’s control, including false or incomplete information provided by the Winner.

  1. Designation and announcement of winners

4.1       The winner(s) of a Promotion shall be selected in an objective and random manner during a draw. Unless explicitly stated otherwise, the winner is selected as described in this article. This selection constitutes a binding decision under Article 7:900 of the Dutch Civil Code.

4.2       Each Promotion shall clearly indicate, where applicable, the qualification draws, the final draw, and the number of winners per draw. Unless explicitly stated otherwise, there is always one Promotion Period followed by one final draw.

4.3       During the Promotion Period, SPPS places copies of delivery notes from qualifying orders into a Sealed Container.

4.4       At the start of the Promotion Period, SPPS shall clearly communicate the deadline date and time. Delivery notes from orders placed before this deadline will be included in the Sealed Container. The live draw will take place several hours to several days after the deadline.

4.5       Draws are broadcast live via YouTube (channel: “Stipt Polish Point”). The date and time of the draw are announced via SPPS’s communication channels (YouTube, Facebook, Instagram, Website) and in the Supplementary Promotional Terms and Conditions if applicable.

4.6       The seal of the container is broken during the live draw. SPPS then randomly selects a delivery note from the container. The Participant named on the selected delivery note is the Winner. Unless explicitly stated otherwise, there is always one Winner per Promotion.

4.7       If multiple delivery notes are drawn in qualification rounds, and one final Winner is selected from among them, the final draw shall follow the same procedure. The last note drawn is the Winner, unless explicitly stated otherwise.

4.8       Participants are responsible for monitoring SPPS’s channels to be aware of the draw schedule. During the live draw, SPPS will attempt to contact the Winner by phone. SPPS will make up to three call attempts. If unreachable, a new delivery note will be drawn. SPPS may use its landline, an employee’s personal number, or an anonymized number. This process repeats until a Winner is successfully contacted. Unreachable Winners forfeit all claims to the prize.

4.9       If the Winner is selected by a method other than described above, this will be specified in the Supplementary Promotional Terms and Conditions or otherwise communicated by SPPS.

  1. Prizes

5.1       Each Promotion shall specify the number, type, and value of prizes, if SPPS chooses to disclose this.

5.2       If a prize becomes unavailable due to force majeure or unforeseen circumstances, SPPS may offer an alternative prize at its discretion. No compensation is owed if a suitable replacement is unavailable.

5.3       Prizes are personal, non-transferable, and not redeemable for cash unless otherwise stated in the Supplementary Promotional Terms and Conditions.

5.4       If a prize is declined or not accepted, SPPS may attempt to award it to another Winner, but is not obligated to do so.

5.5       If the prize is a voucher, it must be redeemed within one year of issuance unless otherwise stated.

5.6       Upon request, the Winner must provide identification to facilitate prize delivery.

  1. Publicity and promotional activities

6.1       By participating, the Participant grants SPPS permission to publish their city, province, submitted materials, and/or responses on SPPS’s website and social media.

6.2       The Winner shall cooperate with reasonable publicity activities related to the Promotion, without entitlement to compensation.

  1. Recordings

7.1       If audiovisual recordings are made during the Promotion (e.g., during qualification, final draw, or prize ceremony), the Participant grants SPPS an unconditional, irrevocable, and perpetual right to use such recordings in any medium, including websites and social media.

7.2       No rights may be derived from verbal statements, promotional expressions, or similar communications from SPPS or the Participant. The Participant is responsible for reviewing and accepting the Promotional Terms and Conditions before purchasing. In case of doubt or dispute, these Terms shall prevail.

7.3 By accepting these Terms, the Winner waives any claims against SPPS regarding the publication of such recordings.

  1. Privacy

8.1       SPPS handles personal data with care and in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Processing is governed by SPPS’s privacy policy.

8.2       Personal data provided for the Promotion is used solely for its organization and execution. Data may be shared with third parties involved in prize delivery or oversight, in compliance with privacy regulations.

8.3       The Participant explicitly consents to the disclosure of their full name and city during the live draw or in content related to the prize.

8.4       If multiple providers are involved, this will be stated in the Supplementary Promotional Terms and Conditions or otherwise communicated.

  1. Liability

9.1       Except in cases of intent or gross negligence, SPPS is not liable for damages arising from the Promotion, including but not limited to:

  1. Typographical errors or obvious mistakes;
  2. Technical failures or delays;

III. Modification or termination of the Promotion;

  1. Failures by third parties (e.g., postal or transport services);
  2. Defects in the prize;
  3. Damage resulting from use of the prize;

VII. Inability of the Winner to use the prize.

9.2       SPPS provides no warranty on prizes.

9.3       If the prize is a non-cash item (e.g., product or voucher), it is used at the Winner’s own risk. SPPS is not responsible for delivery or functionality of third-party products or services. The recipient must consult the third party’s terms. Complaints must be directed to the third party.

  1. Other provisions

10.1     In case of conflict between verbal statements or promotional expressions and these Terms, the Terms shall prevail.

10.2     If SPPS suspects fraud, deception, or unlawful participation, or if the Participant harms the Promotion or SPPS’s reputation, SPPS may exclude the Participant without notice or compensation.

10.3     These Terms do not apply to initiatives organized by advertisers, sponsors, or external parties.

10.4     In cases not covered by these Terms, SPPS shall decide with due regard to the Participant’s interests.

10.5     Questions, comments, or complaints may be submitted via the contact details in the Supplementary Promotional Terms and Conditions. If none are provided, inquiries may be sent to SPPS Customer Service, Eindhovenseweg-Zuid 57, 5683 PW Best, or info@stiptpolishpoint.nl.

10.6     SPPS may unilaterally amend these Terms and any Supplementary Terms. Changes apply to existing participations.

10.7     Changes shall be communicated via the channel used for participation, SPPS’s online channels, or as specified in the Supplementary Terms.

10.8     Participants who disagree with changes may terminate their participation from the effective date of the change.

10.9     SPPS shall announce the start, duration, and end date of the Promotion via the participation channel or social media. Participants are responsible for reviewing deadlines. By accepting these Terms, the Participant indemnifies SPPS from liability in case of exclusion.

10.10   SPPS reserves the right to adjust the duration or cancel the Promotion if circumstances require, in accordance with these Terms.

10.11   Dutch law applies to all disputes related to the Promotion or these Terms. The District Court of Eindhoven has exclusive jurisdiction.

  1. Intellectual property rights

11.1     SPPS reserves all intellectual property rights (including copyright, patent rights, trademark rights, design and model rights, etc.) to products, designs, drawings, writings, data carriers or other information, offers, images, models, etc., unless the parties have agreed otherwise in writing. The customer is not permitted to copy, display, make available to third parties, or otherwise use (or have copied) the aforementioned intellectual property rights without prior written consent from SPPS.
